Terms and conditions

Curious Culture adheres to the general terms and conditions of the Kunstenbond.

1. General

In these terms and conditions, the following definitions apply:

1.1 Contractor: the user of these terms and conditions.

1.2 Client: the party that has requested a quotation from the contractor or has commissioned the contractor to perform services or to create and/or deliver a tangible or intangible work.

1.3 Assignment/Agreement: the contract for services and/or the contract for the creation of work.

1.4 Parties: client and contractor.

1.5 In Writing: written, printed, or via email.

2. Applicability

2.1 These general terms and conditions apply to all quotations from the contractor, all agreements between the parties, and all agreements resulting therefrom.

2.2 These general terms and conditions also apply to assignments in which the contractor involves third parties.

2.3 Oral agreements, deviations from, and additions to these general terms and conditions are only valid if confirmed in writing by the contractor.

2.4 The contractor expressly rejects the applicability of any general terms and conditions of the client unless otherwise agreed.

3. Quotations

3.1 A quotation is any written form of offer made by or on behalf of the contractor, including proposals, price estimates, and offers.

3.2 All quotations are without obligation and valid for two months unless otherwise agreed.

3.3 Prices are exclusive of VAT and expenses incurred for carrying out the work unless otherwise agreed.

3.4 Quotations from the contractor are based on information provided by the client. The client guarantees the accuracy and completeness of this information.

3.5 The rates, fees, and discounts mentioned in the quotation or agreement apply exclusively to the assignment for which they have been agreed.

4. Formation of the Agreement

4.1 An agreement is established when the client agrees to the contractor’s quotation without modification or addition.

4.2 An agreement is also established when the contractor, with the client’s consent, begins executing the assignment. In this case, the contents of the quotation are considered agreed upon.

4.3 If the assignment confirmation contradicts the general terms and conditions, the deviating condition in the assignment confirmation prevails. In all other respects, the general terms and conditions remain in full force.

4.4 The contractor may withdraw the quotation up to two working days after the client has accepted it. In such cases, the agreement is void without further obligations on either side.

5. Execution of the Agreement

5.1 The parties mutually commit to acting as a good contractor and a good client.

5.2 The contractor executes the assignment to the best of their knowledge, expertise, and ability based on a best-efforts obligation unless otherwise agreed or unless the nature of the work entails a results-based obligation.

5.3 Deadlines for executing and completing the assignment are indicative unless otherwise agreed.

5.4 The contractor determines how the assignment is carried out. The work is performed independently and without direction or supervision from the client. The client’s instructions and guidelines regarding the result of the assignment will be observed as much as possible. If proper execution of the assignment requires it, the contractor may engage third parties to perform (parts of) the work.

5.5 The client shall take all reasonable steps necessary for timely and proper delivery by the contractor. In this regard, the client shall ensure the timely provision of accurate, adequate, usable, and complete data and materials necessary for executing the assignment. The client guarantees the accuracy, completeness, and reliability of these materials.

5.6 If the client wishes to add or change elements of the agreed assignment, the contractor may only demand a price increase if the contractor has timely informed the client of the resulting cost increase, unless the client should have reasonably understood the price increase themselves.

5.7 If the assignment is not executed to the client’s satisfaction, the client shall notify the contractor in writing as soon as possible, but no later than ten working days after completion of the assignment. If the client fails to do so, they will be deemed to have fully accepted the results of the assignment.
